Nominating Committee May Name Any Individuals

The NYSE Arca Nominating Committee can now publish one or more individuals as its nominees for non-affiliated directors under Rule 3.2(b)(3)(C)(ii). Previously the Committee could only name OTP Holders or Associated Persons of an OTP Firm or ETP Holder or Associated Persons of an ETP Holder; that limitation is removed. The change became effective upon filing on October 15, 2026, and interested persons may submit comments to the SEC by November 23, 2026; the SEC may temporarily suspend the change within 60 days of filing.
