States must ban flavored nitrous oxide
If enacted, the bill would require States to ban the sale of any scented or flavored product containing nitrous oxide to get Community Mental Health Services Block Grant funds. States would also have to prohibit other nitrous oxide sales unless the State exempts them for medical, veterinary, or dental care; as a food propellant in a commercial kitchen; in manufacturing or industrial operations; or for automotive uses. Before awarding a section 1921 grant, the Secretary would determine whether a State follows the ban. If a State does not follow it, the Secretary would reduce that State's section 1921 allotment for the fiscal year by up to 10 percent of the amount determined under section 1933 for that State. The prohibition would begin in the third fiscal year after enactment.
