More transparency for property takings
If enacted, agencies that must prepare an Environmental Impact Statement would have to estimate how much private property they expect to acquire. The estimate would cover the proposed action and each alternative analyzed. If the EIS names a preferred alternative, the agency would have to explain how public comments about acquisition, including eminent domain, were considered. The agency would also have to state whether the preferred alternative minimizes private-property acquisition compared with the proposed action and other alternatives. This requirement would take effect upon enactment.
