New daily fines for for-profit hospitals
This bill would let HHS impose a civil penalty of up to $10,000 for each day a hospital’s failure continued. The rule would only apply when the Secretary finds the failure immediately jeopardizes patient health and there was a like finding for the same hospital in the prior two years. It would apply to hospitals, critical access hospitals, and rural emergency hospitals with a Medicare agreement that are not nonprofit. CMS would post each such immediate-jeopardy determination on a central public website. These fines could be used in addition to, or instead of, other enforcement actions, and most procedural rules for similar penalties would apply.
