- Qualified career law enforcement officers: Applicants must have completed at least 10 years of service as defined by federal law and not be the subject of a pending criminal investigation or administrative proceeding at application or, if separated, at the time of separation. Those who meet the rules could get express loans without the SBA guarantee fee.
- Small Business Administration: The SBA Administrator may waive the fee ban for any fiscal year if the agency determines the cost of guaranteeing those loans is greater than zero and directly attributable to those guarantees.

No express loan fee for officers
If enacted, the bill would stop the Small Business Administration from charging the guarantee fee on SBA express loans made to qualified career law enforcement officers on or after January 1, 2027. To qualify, you would need at least 10 years of career law enforcement service as defined in 34 U.S.C. 10389. If you are currently employed, you would not be the subject of a pending criminal investigation or administrative proceeding about alleged official-duty misconduct when you apply. If you are separated from service, you would not have been the subject of such a pending investigation at the time you left. The SBA Administrator would be allowed to charge the fee for a fiscal year if the agency finds the net cost of guaranteeing these loans for that year is greater than zero and directly caused by those guarantees.
