Sponsored By: Representative Moulton, Seth [D-MA-6]

Introduced

Summary

Creates eligibility for an immigrant visa or adjustment to lawful permanent resident status for Sindy Gualdina Rodriguez-Fernandez. The bill would waive specific removal and inadmissibility grounds reflected in the Department of Homeland Security or State Department records and require DHS to rescind related orders, treat her as lawfully present if she entered before the filing deadline, require filing with fees within two years, reduce her birth country's immigrant visa allotment by one when a visa or status is granted, and bar her parents, brothers, and sisters from receiving immigration benefits solely from that relationship.

Permanent resident relief for Sindy Rodriguez

If enacted, Sindy Gualdina Rodriguez-Fernandez would be eligible for an immigrant visa or to adjust to lawful permanent resident status despite certain INA limits. She would have to file the immigrant visa or adjustment application with the required fees within two years after enactment. If she entered the United States before that filing deadline, she would be treated as having entered and remained lawfully and could be eligible to adjust status as of the date of enactment. The Secretary of Homeland Security would have to cancel any removal, deportation, or inadmissibility orders shown in DHS or State Department records as of enactment, and she could not be removed or denied admission for those recorded grounds. When she is granted an immigrant visa or permanent residence, the State Department would reduce by one the number of immigrant visas for her birth country in the current or next fiscal year. Her natural parents, brothers, and sisters would not, solely because of that relationship, receive any right, privilege, or status under the Immigration and Nationality Act.
