- Veterans and beneficiaries: Prevents VA competency findings or the decision to pay benefits to a fiduciary from being the sole reason a veteran is treated as a disqualifying "mental defective" for federal background checks.
- VA operations: Requires the VA to notify the Attorney General within 30 days of enactment that any prior basis for sending beneficiary information to DOJ for NICS does not apply or no longer applies.
- Background checks and DOJ: Allows VA to transmit personally identifiable information to DOJ for NICS only when a judge, magistrate, or other competent judicial authority has found the beneficiary is a danger to themselves or others and VA has determined to pay benefits to a fiduciary under section 5502 of title 38.

Limits on VA gun-check reporting for veterans
The VA would not be able to send a veteran’s personal information for gun background checks just because the VA pays benefits to a fiduciary or found the person mentally incompetent. The VA would be barred from treating someone as “mentally defective” for those reasons alone. The VA could share information only if a judge or magistrate finds the person is a danger to themselves or others. Within 30 days of enactment, the VA would have to tell the Attorney General that any fiduciary-only reports sent on or after November 30, 1993 do not apply, or no longer apply.
