This bill would bar federal agencies from using administrative offset to recover overpayments from Social Security, Railroad Retirement, and Black Lung benefits and would rewrite statutes that currently allow those offsets.

  • Social Security recipients. Seniors, people on disability, and other Social Security beneficiaries would be shielded from having their checks reduced by administrative offset to repay debts or overpayments.
  • Railroad Retirement beneficiaries. The bill would extend the same protection to Railroad Retirement and Railroad Unemployment Insurance claimants so their benefits cannot be offset.
  • Black Lung claimants. People receiving Black Lung benefits would no longer face administrative-offset collections against those payments.
  • Federal collection rules. The bill would void parts of 31 U.S.C. 3716 that authorize offsets for these programs and remove related references so agencies lose that tool for collecting from these benefit streams.

Stop Offsets on Social Security Checks
