Mandatory disclosure of third-party funders in civil lawsuits. This bill would require parties and their lawyers to tell the court and all named parties who stands to get money or assets that depend on a case and to hand over the agreements that create that right.

- Parties: A party must disclose the identity of any non-lawyer who has a contingent right to payment or value and must produce any agreement creating that right for inspection and copying. Disclosures must be made no later than the later of 10 days after the agreement is executed or when the action is filed.
- Lawyers: Counsel of record must make the written disclosure and must timely supplement or correct it if it becomes materially incomplete or incorrect.
- Third-party funders and beneficiaries: Agreements become discoverable unless the payment right is only repayment of loan principal; repayment plus interest that does not exceed the higher of 7 percent or two times the annual average 30-year Treasury yield for the prior year; or reimbursement of attorney’s fees.
- Courts and cases: Courts would receive these disclosures and documents and may manage exceptions or orders. The rule would apply to civil actions pending on or commenced after the date of enactment.

New disclosure rules for civil lawsuits
If enacted, parties or their lawyers in civil cases would have to tell the court and all named parties, in writing, who else has a right to get paid based on the case’s outcome. They would also have to give the court and each named party the agreement that creates that right, and related documents, to review and copy, unless the court or all parties agree otherwise. The disclosure would be due by the later of 10 days after the agreement is signed or when the case is filed, and it would have to be updated if it becomes materially wrong or the court orders changes. The rule would not apply if the only right is repayment of loan principal; loan principal plus limited interest (the higher of 7% or twice last year’s average 30‑year Treasury yield); or reimbursement of attorney’s fees. It would apply to cases already pending on the enactment date and to new cases after that.
