Sponsored By: Representative Moolenaar, John R. [R-MI-2]

Introduced

Summary

Prevents Social Security credits for wages or self‑employment income earned while a non‑citizen is not authorized to work. The bill would amend Title II of the Social Security Act to exclude from creditable wages any service performed by an alien during periods the alien is not authorized to be employed and to exclude self‑employment income from a trade or business illegally conducted in the United States. It would apply to earnings before, on, or after enactment and would require the Social Security Commissioner to recompute primary insurance amounts as soon as practicable. The changes would affect benefits only for months after enactment.

No Social Security credit for unauthorized noncitizen work

If enacted, this bill would stop Social Security from counting earnings from work a noncitizen did without work authorization. It would also exclude self-employment income from a business run without authorization. The rule would apply to wages and self-employment income earned before, on, and after the enactment date. Only benefits for months after enactment would change. SSA would recompute benefit amounts as soon as possible, and some future checks could go down if past records are adjusted.
