Summary
Blocks payment networks from assigning merchant codes that single out gun sellers. This bill would stop payment card networks and other covered entities from requiring or assigning merchant category codes that identify a retailer as selling firearms, ammunition, accessories, or components.

- Firearms retailers would not be forced to use MCCs used only or primarily for firearms sellers. They and other individuals could submit complaints to the Attorney General.
- Payment card networks and covered entities would be banned from requiring or assigning such firearms-specific MCCs. If the Attorney General finds a violation the network would be ordered to fix it within 30 days and could face a federal lawsuit if it does not comply.
- State and local laws that regulate or require MCCs used only or primarily for firearms retailers would be preempted.
- The Attorney General would establish a complaint process within 90 days and must send Congress an annual report summarizing investigations and any available data on the law's effectiveness.

Attorney General complaint and enforcement process
If enacted, the Attorney General would set up a complaint process within 90 days. Individuals, including firearms retailers, would be able to submit complaints through that process. The Attorney General would investigate complaints and send a written notice requiring a fix within 30 days. If the violation is not fixed within 30 days, the Attorney General would have authority to bring a Federal court action to stop the behavior. The Attorney General would send Congress an annual report on investigations, summaries, and outcomes. The bill would not create a private right of action.
Ban merchant codes that flag gun sellers
If enacted, the bill would stop payment card networks and covered entities from forcing firearms stores to use gun-only merchant codes. It would bar any MCC that identifies a retailer as selling firearms, ammunition, parts, or accessories. The bill would preempt state and local laws that require or regulate such firearm-only MCCs. It would also define key terms, including ammunition by reference to 18 U.S.C. 921(a)(17)(A), firearms by cross-reference to several 18 U.S.C. 921 subsections, covered entity, firearms retailer, merchant category code, and payment card network.
