Summary

Blocks CMS from enforcing minimum staffing rules and Medicaid institutional payment transparency. This bill would prohibit the Secretary of Health and Human Services from implementing, administering, or enforcing the Centers for Medicare & Medicaid Services' May 10, 2024 final rule on minimum staffing standards for long-term care facilities and Medicaid institutional payment transparency reporting, or any substantially similar regulation, preventing those federal requirements from taking effect without creating new programs or changing other authorities.

Stop CMS nursing home staffing and reporting rule

If enacted, this bill would bar HHS from enforcing a CMS rule issued May 10, 2024 (89 Fed. Reg. 40876). That rule sets minimum staffing in nursing homes and adds Medicaid payment transparency reporting. The ban would also block any substantially similar rule, starting on the date of enactment. Nursing home operators would avoid new staffing and reporting costs. Residents could have fewer guaranteed staff and less spending transparency.
