  • Veterans and students: Would restore entitlement for payments made during defined “covered periods” so those months do not count against an individual’s or the aggregate benefit limits.
  • Educational institutions: Requires an institution to repay any portion of restored entitlement it received for a student and creates a separate appeals process for repayment findings.
  • Department of Veterans Affairs and Treasury: Authorizes the Secretary to seek recoupment from the Treasury for amounts obtained through fraud when institutions are found guilty. Adds a new Section 3699C to Title 38 and covers VA programs under chapters 30, 31, 32, 33, and 35 and Department of Defense programs under chapters 1606 and 1607.

Restore veterans' education benefits, require school repayment

If enacted, this bill would restore VA and DoD education entitlement for veterans and other eligible students. Payments of covered educational assistance during covered periods would not be charged against your entitlement or counted toward aggregate limits. Covered assistance would include VA chapters 30, 31, 32, 33, and 35 and DoD chapters 1606 and 1607. Covered periods include times a school lacked approval, had final VA findings of violations, or was found guilty of fraud by a court. They also include periods when the Department of Justice closed a school for fraud and periods when a school engaged in fraud and later closed. If the Secretary restores entitlement, the school must repay the amounts it received for that student. The Secretary would be authorized to seek recoupment from the Treasury when a court found the school guilty or liable and ordered it to pay relief to the Federal Government. The Secretary would also have to set up a separate appeals process for schools ordered to repay.
