Clearer rules to stop vote barriers

This bill would set clearer tests to challenge vote dilution and vote denial. For dilution, plaintiffs would first show three things—enough protected voters can form a compact majority district, they vote cohesively, and others usually defeat their choice—then courts would weigh listed factors. For denial, a rule would violate the Act if it causes higher costs or burdens for protected groups tied to historic discrimination; a but‑for link would be enough. Courts could give early relief if there is a serious question and the hardship balance favors it, with extra weight for late changes and notice failures. A retrogression rule would bar changes that diminish participation because of race or color for actions on or after January 1, 2021, and the bill would define key terms like voting‑age population and Indian lands to guide these cases.

Stronger review of voting rule changes

This bill would require federal approval for certain voting changes, based on past violations and a list of high‑risk practices. A State would be covered for 10 years if, in the prior 25 years, it had 15 violations; or 10 with at least one by the State; or 3 where the State runs elections. Local areas with 3 violations would also be covered. Covered changes could not take effect until a D.C. three‑judge court approves them or the Attorney General does not object within 60 days. Practice‑based rules would also flag changes like stricter ID, fewer polling places or hours, and redistricting with large shifts, using set thresholds (for example, 20% or 3‑point shifts, or over 5% disparate impact); these rules would start 60 days after enactment. The Attorney General would use Census data to publish where the thresholds apply, and coverage would run from January 1 of the covered year.

More public notice on election changes

This bill would require faster public notice about election changes and resource plans. Jurisdictions would post notice within 10 days after boundary or constituency changes. Larger localities would publish precinct‑level data on voters, machines, and poll workers before the 30th day before a Federal election, and update changes within 48 hours. If a change differs from what was in place 180 days before the election, notice would be due within 48 hours. Notices would need to be accessible to people with disabilities. The Attorney General would be able to give yearly grants to places with 10,000 people or fewer to help meet these notice rules, subject to funding.

More tools to enforce voting rights

This bill would add enforcement tools. The Attorney General could demand documents and answers before suing, with at least 20 days to respond; jurisdictions could ask a court to narrow the demand within 20 days. The Attorney General could assign federal observers, including to enforce bilingual voting protections when meritorious complaints are received. More people could sue to enforce voting laws, and courts could keep cases to ensure fixes. Plaintiffs who win some relief could more easily qualify as a “prevailing party” for attorneys’ fees.

Changes to language‑minority voting rules

This bill would delete certain sentences and paragraphs from the part of law that covers language‑minority voters. If enacted, this could narrow or change how those protections are applied. The change would not set new benefits or funding.
