No Deductions for Marijuana Businesses Act
Sponsored By: Representative Arrington, Jodey C. [R-TX-19]
Introduced
Summary
Bans federal tax deductions and credits for businesses that traffic in marijuana or other Schedule I or II controlled substances. The bill would amend Internal Revenue Code section 280E to deny any deduction or credit for amounts paid or incurred in carrying on a trade or business that consists of trafficking in marijuana or in controlled substances listed in Schedules I and II of the Controlled Substances Act. It uses the CSA definition of marijuana and applies to amounts paid or incurred after enactment in taxable years ending after that date.

No tax deductions for marijuana businesses
If enacted, this would block tax deductions and credits for businesses that traffic in marijuana or other Schedule I or II drugs. It would apply only where that trafficking is illegal under federal law or the state’s law. It would cover amounts paid or incurred after the date of enactment, for tax years ending after that date. Affected business owners would likely owe more tax because they could not write off expenses or claim credits. If your business does not traffic in these drugs, this would not affect you.
