Court review and key Grand Ronde definitions

If enacted, the bill would define key terms. It would define the 1987 federal Consent Decree and the 1986 Grand Ronde Hunting and Fishing Agreement, and use the federal meaning of "Indian Tribe." It would also require the U.S. District Court in Oregon to hear any case to undo or change the Consent Decree on the merits, without using res judicata or collateral estoppel to dismiss it. This would affect parties who seek to change that decree.

New rules for Grand Ronde hunting agreements

If enacted, the current Grand Ronde Hunting and Fishing Agreement would stay in place until the Tribe and Oregon sign a new agreement. They could amend or replace it by mutual consent. Any new or amended agreement could not change or be used to change treaty, ancestral, or other tribal rights. It would not stop Oregon from making separate wildlife agreements with other Tribes in the same area. For agreements made after enactment, any hunting, fishing, trapping, or gathering rights in those agreements would come only from Oregon’s authority. The bill also says it would not decide or affect any tribe’s treaty or sovereign claims.
