New tax credit for brain research firms
If enacted, companies could claim a 25% tax credit for translational research on neurodegenerative and psychiatric conditions. The credit would be part of the general business credit and would require a Treasury allocation. Yearly national caps would apply: $1 billion in 2026; $2 billion in 2027–2030; $1 billion in 2031. Any unused cap would roll to the next year. The same costs could not be claimed for both this credit and the section 41 research credit in the same year, though they could count in the section 41 base for later years. Tax‑exempt entities could elect to pass the credit to an eligible project partner. Treasury, with HHS, FDA, and NIH, would set rules that favor strong science, all research phases, drugs and devices for brain and nervous system disorders, repurposing, and public‑private partnerships. The credit would start at enactment and would not apply to tax years beginning after December 31, 2035.
