Preserve open competition and federal neutrality in labor relations on construction projects. This bill would bar federal construction contracts and federally funded construction project agreements from requiring or banning union agreements or favoring bidders because of union affiliation, and it would extend the rule to grants and cooperative agreements.

Open bidding rules for federal construction

This bill would stop agencies and construction managers from requiring or banning union labor agreements in federal construction bids. It would bar favoritism based on whether bidders sign such agreements. The rule would cover contracts, subcontracts, and construction grants awarded on or after enactment. Contractors could still choose to sign a union agreement. The Federal Acquisition Regulation would be updated within 60 days to put these rules in place. Agency heads would need to act if someone breaks these rules. The bill defines which construction contracts and agencies are covered and excludes the Government Accountability Office.

Safety and security exemptions to bidding rules

This bill would let an agency head grant an exemption when needed to avert an imminent threat to health, safety, or national security. An exemption could not be based on a labor dispute with nonunion workers or firms. A transitional exemption could be allowed if prohibited terms were already in project documents and at least one related contract was awarded before enactment. These decisions would be case by case.
