  • Partners, consent, and travel: A partner chosen by the veteran could receive counseling and treatment and must give consent along with the covered individual and any third-party donor. For travel-pay purposes the partner would be treated as a veteran receiving care.
  • Implementation and legal rules: The Secretary would need to issue regulations within one year and provide up to 180 days of interim policies to continue and expand existing services. State law would determine custody, donation, and disposition of gametes or embryos where they are located.

VA fertility care for veterans and partners

If enacted, VA would offer infertility treatment and fertility preservation to covered veterans and their partners. You must be enrolled in VA care and have infertility or be at risk, as a doctor decides. Coverage would begin once VA issues rules. VA could cover up to three IVF cycles that result in live birth, or up to 10 attempts, whichever comes first. Donated eggs, sperm, or embryos could be used with required written consent from you, your partner (if needed), and any donor. A treated partner would count for VA travel pay. This would not require VA to cover maternity care beyond current law.

VA fertility rollout and interim help

If enacted, VA would have one year to write rules for the new fertility program. From 180 days after enactment until those rules are issued, VA could keep services going and expand some access. During this interim, partners could get care without being married, and donated eggs, sperm, or embryos could be used. If you were already in VA fertility care the day before rules are issued, you could stay under old rules or switch to the new section, with past services counting toward any limits.

State law controls embryo decisions

If enacted, state law would decide the legal status, custody, use, donation, or destruction of eggs, sperm, and embryos used or stored under VA fertility care. The rules would follow the state where the material is located. This would apply once VA issues rules. Outcomes could differ by state.
