Blocks state-controlled or state-partly-owned foreign entities from owning or operating U.S. port facilities. The act prohibits owners or operators of facilities that require a facility security plan from entering ownership, leasing, or operation contracts with state-owned enterprises of China, Russia, North Korea, or Iran or with any foreign entity that any of those states partly owns.

Port owners face bans on certain contracts

This bill would bar owners and operators of certain port facilities from some contracts. They would be unable to enter contracts for ownership, leasing, or operation with state-owned firms from China, Russia, North Korea, or Iran. They also could not contract with any foreign company that has any ownership stake from those countries. The rule would apply only to facilities that must have a federal facility security plan. If enacted, this could shrink bidder pools and raise costs to replace contractors, while aiming to improve port security.
