HR2708119th Congress

Safeguarding American Property Act of 2025

Sponsored By: Representative Downing, Troy [R-MT-2]

Introduced

Summary

Expands detention triggers for noncitizens convicted of property crimes. The Safeguarding American Property Act of 2025 would amend 8 U.S.C. 1226(c) to add trespassing, vandalism, and arson to the list of offenses that may subject a criminal alien to detention. It replaces the statute's phrase "and 'serious bodily injury'" with an explicit list of "serious bodily injury", "trespassing", "vandalism", and "arson". The changes are confined to Section 236(c) and do not create new funding or programs beyond expanding the set of detention triggers.

More crimes trigger detention for noncitizens

If enacted, more property crimes would trigger immigration detention. The bill would add trespassing, vandalism, and arson to the mandatory detention list in immigration law. Noncitizens charged or convicted of those crimes could face mandatory detention. This is in addition to crimes already listed, like burglary. The bill sets no start date and adds no new funding.
