Treat diapers as qualified medical expenses across tax-advantaged accounts and bar state and local sales taxes on retail diaper purchases. This bill would move diapers into eligible medical and dependent care expenses to reduce costs for families with young children.

  • Families and children: About 46 percent of families with children under four struggle to provide diapers. Annual diaper costs are about $945 to $1,500 per child and low-income families spend roughly 2.6 times more of their income on diapers than median-income families.
  • Account holders and employers: The bill would allow Health Savings Accounts, Archer Medical Savings Accounts, Health Flexible Spending Arrangements, Health Reimbursement Arrangements, Limited Purpose FSAs and HRAs, and Dependent Care Assistance accounts to cover diapers. Those changes apply to amounts paid or expenses incurred after December 31, 2024.
  • Workers and household budgets: About 25 percent of caregivers with diaper need miss work or school, averaging 5.1 workdays in the prior 30 days and about $296 in lost earnings per month at the federal minimum wage.
  • State and local tax treatment: States and units of local government would be prohibited from imposing sales or use taxes on retail diaper purchases.

Pay for diapers with HSAs and FSAs

If enacted, you could use an HSA, Archer MSA, FSA, or HRA to pay for diapers or get reimbursed. Dependent care FSAs could also reimburse diaper costs. These changes would apply to amounts paid or expenses incurred after December 31, 2024. Limited-purpose FSAs or HRAs would not lose HSA compatibility just for covering diapers; that rule would apply to months starting after December 31, 2024. You must have one of these accounts to benefit.

No state sales tax on diapers

This bill would bar states and cities from charging sales or use tax on retail diaper purchases. It would take effect upon enactment. Shoppers would pay no state or local sales tax on diapers at the register.
