  • A surviving child who acquires the deceased veteran’s ownership interest would be able to keep the business’s service-disabled veteran-owned status for up to 3 years, if the business was veteran-owned immediately before the veteran’s death and remains listed in the section 36 database.
  • Small businesses would retain access to veteran-focused contracting programs and set-asides during the ownership transition, subject to the ownership and database conditions.
  • The protection ends earlier if the surviving child relinquishes ownership or after 3 years. The bill defines “surviving child” as the biological or legally adopted child of the service-disabled veteran.

Veteran-owned small firms keep status after death

If enacted, some small firms could keep their service‑disabled veteran‑owned status after the veteran owner dies. This would apply if a surviving child takes the veteran’s ownership share. The firm must be in the section 36 database before the death and stay listed during this period. The status would last up to 3 years after death, or end sooner if the child gives up ownership. It would only cover firms that qualified right before the death and then fell below 51% veteran ownership because of it.
