Tax-saving funds for port equipment
Marine terminal operators would be able to set up Capital Construction Fund accounts, not just vessel owners. They could deposit money and make qualified withdrawals to buy, replace, or rebuild cargo-handling equipment for use at U.S. terminals. Cargo gear would mean vehicles and landside equipment used to lift or move cargo; foreign-made gear would count only if suitable U.S. gear is not reasonably available, as the operator determines. Accounting and tax rules would be updated so this gear is treated like vessels for deposit limits, withdrawal order, and basis. These changes would take effect upon enactment.
Port operators face crane and automation limits
Operators would not be able to use Capital Construction Fund money to buy cranes manufactured in the People’s Republic of China. They also could not use the fund to buy fully automated cargo equipment if the Secretary finds it would cause a net job loss at a terminal. The rule covers remotely operated or remotely monitored equipment. These limits would take effect upon enactment.
