Summary
Gives the Bay Mills Indian Community control over its non‑trust land transactions. This bill would let the Tribe, and its agents or instrumentalities, transfer, lease, encumber, or otherwise convey any real property that is not held in trust by the United States without further federal approval. It clarifies that lands held in trust by the United States remain excluded from this authority. It also limits the United States' liability for losses from those tribal land transactions unless the United States is a party or is otherwise legally liable.

Bay Mills tribe land sale authority
This bill would let the Bay Mills Indian Community transfer, lease, encumber, or sell any real property it owns that is not held in trust by the United States. The Tribe could do these transactions without extra federal authorization and notwithstanding other laws or regulations. The bill would not let the Tribe transfer lands that are held in trust by the United States. The United States generally would not be liable for the terms of, or losses from, these transactions unless the United States is a party to the deal or would be liable under other law. That liability rule would not apply if the Tribe gives land to the United States to be held in trust for the Tribe.
