Summary
Clarifies DOE authority to allow certain foreign-origin americium-241 sealed sources to be disposed at the Waste Isolation Pilot Plant (WIPP). This bill would create a statutory pathway so the National Nuclear Security Administration can move qualifying foreign-origin Am-241 materials to WIPP when they meet WIPP Waste Acceptance Criteria and statutory definitions.

If enacted, the Energy Department would be able to collect, store, and dispose of some foreign‑origin radioactive sources at the Waste Isolation Pilot Plant (WIPP). The materials would need to contain transuranic elements (like americium‑241) and meet WIPP’s Waste Acceptance Criteria and legal definitions. For WIPP purposes, they would be treated like defense‑generated waste. Russian‑origin sealed sources that pass the criteria would be eligible. DOE’s field office estimates about 1 to 2 shipments per year, with a negligible impact on operations.
