More Customs data sharing, higher bar
If enacted, Customs would be able to share more nonpublic data on suspected fake or infringing goods. It would include images, labels, packaging, packing materials, and containers, and data from online marketplaces, express shippers, and freight forwarders that Customs already has. Customs would be allowed to give this to rights holders and other parties with an interest in the goods, as approved by the Commissioner. But Customs would need a reasonable suspicion of a violation before sharing. When it shares this marketplace or shipper data, Customs would also notify the recipient under rules set by the Secretary. These changes would take effect when the bill becomes law.
