Parents Opt-in Protection Act

Sponsored By: Representative Miller, Mary E. [R-IL-15]

Introduced

Summary

Requires explicit written opt-in consent before schools collect personal information about a student or their family through surveys, analyses, or evaluations. It would amend Section 445 of the General Education Provisions Act to replace "prior consent of the student" with "prior written consent" and to require consent "for such specific survey, analysis, or evaluation".

Show full summary
  • Parents of unemancipated minors would have to give prior written consent before a student can take surveys that ask about the student or the student’s family.
  • Adult students and emancipated minors would need to provide their own prior written consent for those surveys.
  • Schools and districts would be required to obtain written consent tied to each specific survey, analysis, or evaluation before collecting the covered personal information.

Written consent for sensitive student surveys

If enacted, schools would need written permission before giving surveys that ask certain personal questions. Consent would have to be for that specific survey, not a blanket OK. Parents would have to sign for unemancipated minors. Adult students or emancipated minors would sign for themselves. Schools could not require students to take these surveys without that written consent, starting upon enactment.
