- States would need to confirm an applicant’s lawful immigration status or U.S. citizenship or lawful permanent resident status before issuing, transferring, renewing, or upgrading a CDL under the new rules.
- Applicants domiciled in foreign jurisdictions would be eligible only if they have lawful immigration status, hold a visa the Secretary ties to an employment-based reason for a CDL, and receive a license for up to 1 year or until their authorized U.S. stay ends.
- Applicants domiciled in Puerto Rico, the U.S. Virgin Islands, Guam, American Samoa, or the Northern Mariana Islands would be eligible only with proof of U.S. citizenship or lawful permanent resident status confirmed by the state.
- The Secretary of Transportation would prescribe implementing regulations and require states to retain issuance records for at least 2 years and provide those records to the Secretary within 48 hours when requested.
