- Members of Congress: Members would not receive pay from the Treasury for any days when Congress misses the two requirements. The Vice President is excluded.
- Budget and Appropriations Chairs: House and Senate Budget and Appropriations Chairs would decide whether Congress met the budget and appropriations tests and certify pay status after requests from the House Chief Administrative Officer or the Secretary of the Senate.
- Timing: The rule would take effect September 29, 2027 and requires certification each year around October 1 about compliance for that fiscal year.

If enacted, starting September 29, 2027, Members of Congress would not be paid for days when Congress misses the October 1 budget and spending bill deadline. The House and Senate Budget and Appropriations Chairs would certify when noncompliance happens and how many days pay is withheld. Treasury would not be able to pay for those days, and no back pay would be allowed later. The Vice President would not be covered.

If enacted, beginning September 29, 2027, both chambers would need to, by October 1 each year, approve a budget plan and pass all regular spending bills. On October 1, the Secretary of the Senate and the House Chief Administrative Officer would request certifications. The Budget and Appropriations Chairs would certify if each chamber met the deadline and, if not, the number of days without pay for Members. These steps aim to enforce the deadline and could reduce shutdown risk, but results are not guaranteed.
