Bill Overview

Analyzed Economic Effects

3 provisions identified: 2 benefits, 0 costs, 1 mixed.

Civil money damages for victims

If enacted, a woman who is given an abortion‑inducing drug without informed consent would be able to sue the person who did it. She would be able to get objectively verifiable money damages for medical and psychological harms, plus statutory damages equal to three times those verifiable costs. A court could also award punitive damages. A prevailing plaintiff would get reasonable attorney fees, and a prevailing defendant could get fees if the suit was frivolous.

Federal crime for non‑consensual abortion drugs

This bill would make giving an abortion drug to a pregnant woman without her informed consent a federal crime when it occurs in or affects interstate or foreign commerce. Violators would face fines and up to 25 years in prison. Attempts and conspiracies would carry the same penalties. If the act causes serious bodily injury or death, the offender could face up to 25 more years in prison on top of the base sentence.

Definitions that set who is covered

The bill would define key words used in the criminal and civil rules. It would define "abortion" and list two specific ways it applies. It would define "abortion‑inducing drug" and name mifepristone and misoprostol. It would define "conspiracy" to include selling or mailing drugs without reasonable steps to confirm the recipient is a pregnant woman seeking an abortion. It would also define "informed consent" and cross‑reference "serious bodily injury" and "unborn child."
