  • States and territories: Would treat the term "State" in the Fourteenth Amendment and other constitutional provisions as including the District of Columbia, the Commonwealth of Puerto Rico, and each other U.S. territory or possession.
  • Federal powers and definitions: Would define "human person" and "human being" to include every member of Homo sapiens at all stages of life and affirm Congress can use its Article I and Fourteenth Amendment powers to enact laws to protect that right.

New constitutional protection for preborn life

This bill would say the constitutional right to life applies to every human being at all stages, including at fertilization or cloning. It would define “human person” and “human being” to include members of Homo sapiens from the moment they come into being. It would also say the word “State” in the 14th Amendment covers DC, Puerto Rico, and U.S. territories. If enacted, this could change court decisions and affect access to reproductive health care and related lawsuits. The bill would also say it cannot be used to prosecute a woman for the death of her unborn child.
