New Crimes for Improper Voter Help
If enacted, the bill would add new criminal offenses for executive-branch officers or employees who give material help to a noncitizen attempting to register or vote in a federal election. It would also make it a crime to register someone who fails to present documentary proof of U.S. citizenship. Private parties would be expressly allowed to sue election officials who register applicants without the required documentary proof. These changes would take effect on enactment.
New Photo ID Rules for Voting
If enacted, everyone voting in a federal election would have to present an eligible photo ID. In-person voters would show a tangible (non-digital) photo ID at the polling place. Absentee voters would include a copy of the same eligible photo ID with their absentee ballot request and with the returned ballot. Eligible IDs must show a photograph, a front-facing indication of U.S. citizenship, and either a State motor vehicle ID number or the last four digits of your Social Security number; a document lacking the citizenship marking can be paired with another document that shows citizenship. The bill would allow an exception to the citizenship-mark rule for States that have submitted registration lists to DHS's SAVE system at least quarterly since June 1, 2025 and that mark each voter record with DHS verification and date.
Show Proof to Register to Vote
If enacted, you would have to submit documentary proof you are a U.S. citizen when registering to vote in federal elections. States could not accept or process a federal-office registration unless one of the listed documents or combinations is presented with the application. If you used the federal mail form, you would need to present proof in person by the State registration deadline or at the polling place on election day where same-day registration is allowed. Officials could register someone without documents only by following an Election Assistance Commission process that uses a sworn affidavit, supporting evidence, and an official explanation; states must provide disability accommodations.
States Must Check Voter Citizenship
If enacted, each State would have to set up a program, within 30 days, to identify registrants who are not U.S. citizens using sources like DHS SAVE, SSA verification, or State ID records. States would remove anyone found not to be a U.S. citizen after receiving documentary proof or verified information. Federal department heads would have to provide requested verification information to State election officials within 24 hours and could not charge fees. The Department of Homeland Security could use SAVE, investigate unlawful registrations for potential removal, and must tell States quickly when someone becomes a naturalized citizen. The Election Assistance Commission would have to issue guidance to States within 10 days of enactment.
