For reclassifications after October 1, 2026, hospitals would have to be located in an urban area and meet specific tests, and any statutory designation used to claim rural status would need to have been in effect on January 1, 2026. For fiscal years starting October 1, 2026, the Medicare Geographic Classification Review Board would be barred from approving or making effective reclassification decisions that conflict with hospitals already treated as rural under the rule. Starting October 1, 2029, no subsection (d) hospital would be treated as rural under this provision unless it demonstrates to the Secretary that it meets the listed criteria.
