Medicaid deeming for VA nursing homes

If enacted, the bill would make the Medicare deeming rule available under Medicaid for State Veterans Homes inspected and certified by the VA. That means VA inspections could count as meeting Medicaid survey and certification requirements for qualifying State homes, but only when the HHS Secretary has approved the VA standards. This would take effect 90 days after enactment.

Public reporting of VA home inspections

If enacted, HHS would coordinate with the VA to add VA inspection findings, deficiency statements, and quality metrics for VA-certified State homes to the Nursing Home Care Compare website (or successor). Data would be included to the extent feasible and consistent with law and CMS reporting methods. HHS would also issue guidance, in consultation with VA, within 180 days after enactment to align certification and data reporting processes for consistent public reporting. The public reporting changes would take effect 90 days after enactment, and the guidance must be issued within 180 days.

Congress must be told about VA alignment

If enacted, the HHS Secretary would have to notify four congressional committees in writing within 15 days after any of these: approving VA standards for deeming, revoking or suspending deemed status, or identifying material non-alignment between VA inspection practices and Medicare rules. The notices must go to the House and Senate Veterans' Affairs and the House Energy and Commerce and Senate Finance committees.

Medicare deeming for VA nursing homes

If enacted, the HHS Secretary would be able to treat a State Veterans Home inspected and certified by the VA as meeting Medicare nursing facility rules. This would apply only after the Secretary approves the VA standards and the VA provides inspection documentation and submits its standards and procedures at least once every two years for joint review. The Secretary would require VA inspections and enforcement to include CMS survey protocols and enforcement expectations and could revoke deemed status or impose remedies if VA processes do not meet Federal transparency, data quality, or enforcement standards. These changes would take effect 90 days after enactment.
