Safeguarding Women from Chemical Abortion Act

Sponsored By: Representative Harshbarger, Diana [R-TN-1]

Introduced

Summary

Withdraws federal approval of mifepristone for termination of intrauterine pregnancy and establishes a new federal tort allowing lawsuits against its manufacturers. This bill would deem FDA approvals for mifepristone (marketed as Mifeprex, also known as RU‑486) withdrawn 14 days after enactment and would create a private cause of action tied to that drug.

Bill Overview

Analyzed Economic Effects

2 provisions identified: 1 benefits, 1 costs, 0 mixed.

Right to sue mifepristone makers

This bill would let any person who suffered bodily injury or mental-health harm tied to using mifepristone sue the drug maker. You could bring the case in a federal or State court. You could seek compensatory damages, punitive damages, and attorney fees and costs. This would take effect 90 days after enactment and would not stop State laws that give other remedies.

Withdraws FDA approval for mifepristone

This bill would treat FDA approval for mifepristone to end pregnancy as withdrawn 14 days after enactment. Making, importing, delivering, or selling the drug for that use would be a federal violation. Labels saying the drug may be used to end intrauterine pregnancy or with another drug for that purpose would be considered misbranding. If enacted, this could reduce nationwide access and raise legal and compliance risks for manufacturers, pharmacies, clinicians, and patients.
