Summary

Retroactive benefits for military sexual trauma would be available to veterans who win disability claims tied to MST. The bill would set the award's effective date as the day after discharge and make monetary payments retroactive to that date, overriding the usual timing rules in 38 U.S.C. 5110 and 5111. It limits covered conditions to mental health conditions defined in 38 U.S.C. 1166(c)(1) and to physical injuries or diseases caused or worsened by MST. The bill also adds a new section 5114 to chapter 51 and updates the chapter table of sections.

Back pay for veterans with sexual trauma

If enacted, veterans awarded VA disability for a health condition caused by military sexual trauma experienced during active service would have the award effective date set to the day after their discharge. Monetary payments would be payable retroactively starting on that post-discharge date, even if other VA timing rules would normally set a later effective date. Covered health conditions would include mental health conditions defined in current VA law and any physical injury or disease caused or aggravated by military sexual trauma. The rule would apply only after the VA approves a compensation claim for the covered condition.
