Summary
Count out-of-pocket drug payments toward a person’s deductible and out-of-pocket maximum. This bill would require group health plans and health insurers to credit any money an enrollee pays when they buy a drug without using plan benefits toward the deductible and the plan’s out-of-pocket cap.

Count cash drug payments toward limits
This bill would require group health plans and issuers to count cash payments you make for a drug toward the deductible and out-of-pocket maximum that would have applied if you used benefits. The rule applies when you buy a drug covered by your plan but choose not to apply plan benefits. It would apply to ERISA plans, insured group or individual coverage, and Federal plans. The change would take effect for plan years beginning on or after January 1, 2027.
