Summary

Count out-of-pocket drug payments toward a person’s deductible and out-of-pocket maximum. This bill would require group health plans and health insurers to credit any money an enrollee pays when they buy a drug without using plan benefits toward the deductible and the plan’s out-of-pocket cap.

Bill Overview

Analyzed Economic Effects

2 provisions identified: 1 benefits, 0 costs, 1 mixed.

Exclude cash discounts from AMP and best price

This bill would change how drug makers and programs calculate Average Manufacturer Price (AMP) and the Medicaid "best price." Price reductions tied to purchases made when an individual does not apply plan or program benefits would be excluded from AMP and best price calculations. That would help manufacturers avoid having cash discounts lower benchmark prices, and it could raise what Medicaid and some insurers pay. The effect on premiums or patient costs is unclear.

Count cash drug payments toward limits

This bill would require group health plans and issuers to count cash payments you make for a drug toward the deductible and out-of-pocket maximum that would have applied if you used benefits. The rule applies when you buy a drug covered by your plan but choose not to apply plan benefits. It would apply to ERISA plans, insured group or individual coverage, and Federal plans. The change would take effect for plan years beginning on or after January 1, 2027.
