Congressional approval for EPA dismissals

If enacted, the bill would stop the EPA Administrator from dismissing an EPA lawsuit or withdrawing a DOJ referral in a covered claim unless Congress approves by a special joint resolution. The Administrator would first have to notify both Houses of Congress. The joint resolution must be introduced within 30 days after that notice, committees must report within three legislative or session days or be discharged, and floor debate would be short, non-amendable, and normally limited to two hours. The joint resolution would also have strict form rules (no preamble and a precise resolving clause and title). These procedures would take effect upon enactment.

Definition of covered cancer claims

If enacted, the bill would define a "covered claim." It would mean a case accusing someone of releasing into the environment a chemical that the EPA's IRIS has found to be a likely or known human carcinogen. The definition would decide which lawsuits and DOJ referrals must follow the bill's special notice and congressional-approval rules. This definition would take effect upon enactment.
