New legal tools to prosecute CCP
If enacted, the Attorney General would designate the Chinese Communist Party a transnational organized crime group on the date of enactment. On that date, the FBI Director would list the CCP as a top international criminal organization for the Department of Justice. Within 90 days, the Attorney General would report to Congress on racketeering acts by the CCP and recommend penalties. The bill would pause any shorter statute of limitations so prosecutions are not precluded until 15 years after the alleged racketeering activity. It would also remove foreign-state immunity for the CCP during such investigations or if it is charged.
