No Rigged Grocery Prices Act

Ban on personalized grocery pricing

If enacted, the bill would ban covered entities from using a consumer's personal data to raise food prices. Covered entities would include food retailers with at least 15,000 square feet and third-party delivery services. The bill would define "dynamic pricing" and "personal data" to set what is banned. It would still allow price differences that reflect objective costs, such as shipping and taxes. It would also allow voluntary loyalty or promotional deals, temporary retention discounts, and offers where the consumer consented to provide personal data. For online orders, the bill would require sellers to disclose when an item's availability changed and when price is based on weight. Third-party delivery services would need explicit consumer approval before substituting an item. Violations would be treated as unfair or deceptive acts under the Federal Trade Commission Act. The FTC would enforce the rules using its usual powers and penalties. These rules would take effect upon enactment.
