- Owners and operators of wells that average at most 15 barrels of oil per day (or 15 barrels oil equivalent) or at most 90,000 cubic feet of gas per day would be exempt from applicable standards and from monitoring, reporting, record-keeping, leak detection, emission estimation, measurement, and similar compliance duties. A "well site" covers the well and associated on-site equipment but stops at the point of custody transfer.
- State air quality plans could not require performance standards for marginal wells. If a state revises a plan to remove such a standard, the Environmental Protection Agency would have 180 days to act on that revision or it would be deemed approved.
- The Environmental Protection Agency would have 180 days after enactment to revise regulations and guidance to implement the change, and any pending enforcement actions tied to those standards for marginal wells would be terminated.

Marginal well rules for small operators

A marginal well would be one averaging no more than 15 barrels of oil per day (or 15 barrels oil equivalent using 6,000 cubic feet per barrel) or no more than 90,000 cubic feet of gas per day, measured over the preceding calendar year. The exclusion would bar federal standards and related obligations like monitoring, reporting, leak detection, record-keeping, and emissions measurement. The bill would also stop EPA from requiring State section 111(d)(1) plans to cover marginal wells. EPA would have 180 days after enactment to update regulations and guidance, must act within 180 days on State plan revisions that remove marginal wells (or those revisions are deemed approved), and any pending enforcement against a marginal well would be terminated.
