Legal orientation for detained noncitizens
If enacted, the bill would create an Office of Legal Access Programs inside EOIR to run legal orientation programs. The Attorney General would have to send a plan to Congress within 180 days. The plan would include a schedule to deploy programs for all detained people within one year. The Secretary of Homeland Security, with the Attorney General, would ensure programs are available within five days of arrival. Programs and written notices would be in English and the five most common native languages at each site. Programs would identify unaccompanied children, people with serious mental disabilities, and other vulnerable people. Programs could serve noncitizens in proceedings under INA sections 235, 238, 240, and 241(a)(5). Funding would come from appropriations of "such sums as may be necessary." The bill would also state that these orientation rules do not create enforceable legal rights against the United States.
