Protecting Student Privacy Act

Protect student aid privacy for families

If enacted, this bill would bar federal student aid information used for Title IV (FAFSA) from being shared with immigration-enforcement agencies. That includes DHS, federal agencies with immigration authority, and state or local agencies operating under 287(g) agreements. Two narrow exceptions would apply: a court order tied to a criminal offense alleged against the student, and clear, voluntary consent by the student or a contributor; consent would not count if an agency requested, coerced, or pressured it. The Secretary would have to report to Congress any disclosure learned to be in violation, and the section would override other laws to the extent they would permit such disclosures.
