Public disclosure of confidential drug-pricing deals. This bill would make HHS publish contracts, communications, metadata, and related records for covered drug pricing agreements from January 20, 2025 in a centralized, searchable, downloadable format.

New reports on drug deal impacts

If enacted, the Director of the Congressional Budget Office and the Comptroller General would publish a joint analysis within 90 days after the release of the listed agreements. The report would estimate economic and budget effects for each deal, expected savings to people by insurance status (including the uninsured), and budget impacts on Medicare, Medicaid, and ACA exchange plans. If enacted, the HHS Secretary would also send Congress, within 15 days after the release is complete, a list of all documents released and withheld and a summary of any redactions and legal bases.

Public drug pricing deal disclosures

If enacted, HHS would publish, in a single searchable place, federal records about covered drug-pricing deals made on or after January 20, 2025. The release would include named deals publicly announced by the White House or manufacturers and must happen not later than 30 days after enactment for existing deals. New deals or changes after enactment would be disclosed not later than 30 days after ratification. HHS would not be allowed to withhold records because of reputational harm or political sensitivity.
