This bill would add new immigration penalties to block foreign government officials who carry out economic discrimination against U.S. persons. It would make such officials inadmissible at the border and removable from the United States.

  • United States persons (individuals and businesses): Gain a new protection. Officials who subject you to harsher investigations, enforcement actions, licensing denials, fines, fees, tax assessments, or other administrative burdens than similarly situated non‑U.S. parties could be the basis for exclusion or removal.
  • Foreign government officials acting in an official capacity: Face two new legal grounds. Their discriminatory investigations, enforcement actions, licensing determinations, fines, fees, tax assessments, or other legal, regulatory, or administrative burdens could make them inadmissible or deportable.
  • Immigration authorities and courts: Would get a new tool that requires comparing treatment of a U.S. person to a similarly situated non‑U.S. person and allows multiple actions to be considered “taken together” when deciding inadmissibility or deportability.

Bar foreign officials who discriminate

If enacted, the bill would make some foreign government officials inadmissible and deportable. It would apply when an alien serving as a foreign government official starts, directs, or carries out investigations, enforcement actions, licensing decisions, fines, fees, tax assessments, or other legal or administrative burdens against a United States person. The actions must be more severe, more frequent, or less procedurally favorable than those taken against a similarly situated non-U.S. person, taken individually or together. Officials who meet that comparison test would be barred from admission and could be removed if present.
