Veteran’s Surviving Spouse Parity Act of 2026

Sponsored By: Representative Moore, Gwen [D-WI-4]

Introduced

Summary

Treats certain spouses and surviving spouses of veterans as veterans for the 3-year ownership look-back used in qualified mortgage bonds and mortgage credit certificates. This bill would expand who counts as a veteran when applying that ownership exception and require Treasury, with VA, to issue guidance on verification and remarriage rules.

More mortgage help for veteran spouses

If enacted, this bill would let certain spouses and surviving spouses count as "veterans" for the 3-year ownership look-back used by qualified mortgage bonds and mortgage credit certificates. This applies when the spouse is treated as a veteran under 38 U.S.C. 3701(b)(3), or the surviving spouse is treated as a veteran under 38 U.S.C. 3701(b)(2) or (6). The change would apply to bonds and mortgage credit certificates issued after December 31, 2026. The Treasury, in consultation with the VA, would issue guidance to help issuers decide who counts as a veteran, including remarriage rules for surviving spouses.
