- Families and new parents: A newborn would get 30 days of coverage for any service the parent’s plan already covers. Parents would have at least 60 days after that 30-day period to enroll the child.
- Employers and plans: Group health plans regulated under the Public Health Service Act, the Employee Retirement Income Security Act (ERISA), and the Internal Revenue Code would have to provide the 30-day coverage, the 60-day special enrollment, and immediate notification when a claim is filed for an unenrolled newborn.
- Insurers and consistency: The bill aligns the same three requirements across the three major federal statutes so newborns face the same short-term protection regardless of plan type.

Temporary newborn coverage for parents
If you are a parent with a group health plan, your newborn would be covered for 30 days after birth for services the plan normally covers. The plan would give you at least 60 more days after that to enroll the baby. If the plan or issuer gets a bill or claim for the baby and the baby is not enrolled, the plan would notify you right away. These rules would apply to group plans and issuers under PHSA, ERISA, and the tax code, starting in plan years beginning on or after enactment.
