New reporting for AI training data
If enacted, the bill would require anyone who uses a dataset to train or release a generative AI model to file a notice with the Register of Copyrights. Each notice would include a sufficiently detailed summary of every copyrighted work in the dataset. If the dataset is publicly online, the notice would include the dataset's web address. For new models, notices would be due at least 30 days before commercial use or release. For models already used or released before the bill's effective date, notices would be due within 30 days after the Register issues rules. The bill would take effect 180 days after enactment, and the Register would have 180 days after the bill's effective date to set form, content, and filing procedures and to build a public online database of notices.
Penalties for missing AI notices
If enacted, copyright owners could sue anyone who used their registered copyrighted work in AI training but did not file the required notice. Courts could order a civil penalty of at least $5,000 for each failure, with penalty money paid to the Register to offset Copyright Office costs. A person's total civil penalties could not exceed $2,500,000 in any year. Courts could also issue injunctions stopping use of the work until the notice is filed and award attorney's fees and expenses. This enforcement would take effect 180 days after enactment.
