Foreign Service Age Integration and Reform (FAIR) Act of 2026
Sponsored By: Senator Rosen, Jacky [D-NV]
Introduced
Summary
Aligns the Foreign Service's mandatory retirement age with Social Security's Full Retirement Age. This bill would replace the current fixed retirement age of 65 with the greater of age 67 or an individual's Social Security Full Retirement Age as defined in section 216(l) of the Social Security Act, so some employees could have a higher mandatory retirement threshold depending on their birth year.

Higher retirement age for Foreign Service
This bill would raise the mandatory retirement age for covered Foreign Service members. Instead of a fixed age 65, mandatory retirement would be at the greater of age 67 or your applicable Social Security retirement age as defined in Social Security Act section 216(l) (42 U.S.C. 416(l)). The change would apply to persons subject to mandatory retirement under current Foreign Service law and would take effect upon enactment.
